Information technology has fundamentally changed the products and services that we buy and has reshaped the entire relationship between companies and customers both B2B and B2C. High-tech products, (social) media and data-driven business models are faster, more adaptable and more disruptive than ever before. Regulators were initially slow to address the risks inherent in these new developments, both in terms of consumer protection, privacy as well as fair competition. But China is rapidly developing laws, regulations and technical standards to govern the digital space. Keeping up with fierce competition in almost every market, while at the same time staying on top of the cyber and data compliance game is the new challenge.

Digital regulation is pervasive and it is hard to have everything in focus. In this workshop, we will give you the legal 101 on some key areas:

  • Your online presence: what are legal requirements and disclosure rules for setting up and maintaining your website? Are foreign-invested businesses allowed to set up online shops?
  • Cookies, tracking, web analytics: what do you need to put into those "privacy statements"?
  • Update on data localization requirements.
  • Direct marketing: WeChat & email marketing; interactive marketing: did users provide consent?
  • Selling your online real estate as a foreign invested company?
  • Fighting unfair competition such as online IP infringement or fake online reviews.
